FACTS YOU NEED TO KNOW
The
initial step in completing
the
discovery process is when your attorney attempts to get
all the evidence that the prosecutor has
against you to be used at trial. After being retained,
Komorn Law will immediately file a discovery motion,
compelling the production of all essential documents and
records, for the best defense possible.
The
following information is critical:
If a preliminary breath test was taken the records of
the accuracy of the calibration of said machine must be
provided.
Breathalyzer simulated
testing results for the six months prior to the night of
the breath test and the arrest, as well as for the one
month after the arrest must be provided.
The training and certification of the breathalyzer
operator.
If blood test was
taken, all medical records from
the hospital relating to treatment and blood test
taking.
Whether the testing complied with the laboratory
standards required to ensure accuracy of the test
results will be investigated.
